A separation agreement helps establish:

- who remains in the home during the process

- what happens if one person delays cooperation or refuses to sign documents

Without a clear agreement, problems often arise later. Disputes over pricing, occupancy, expenses, repairs, timelines, or access to sale proceeds can delay the transaction and increase legal costs significantly. In some cases, lawyers may advise against listing the property until key terms are documented.
